Air filter and power surge issues

i first had a spree that ran up to 45km/h then it broke, brought another that ran really rough but also went up to 45km/h. so i made one brilliant scooter out of the both of them, now it only goes up to 39km/h.

i dont think its the carb as iv tried both carbs and it still runs the same. so i tried the air filter.

one air filter is ripped with holes in it, with the outside case all in tact and stock.

the second is New quality filter with small square hole cut in top of cover, when i run this second air filter it runs better with no surges in power but still max's out at 45km/h!

Help!!!
